The Curia rejected the legal action brought against the decision of the assembly authority prohibiting a march notified by a private individual with the scheduled date of 2 August 2025 to celebrate fundamental rights.
The plaintiff has notified the defendant assembly authority of his intention to organize a march between 12:00 p.m. and 20:00 p.m. on 28 June 2025 in Budapest, along the route Széchenyi Square – Chain Bridge – Buda Castle Garden Bazaar – Döbrentei Square – Elisabeth Bridge – Lower Quay of Pest – Széchenyi Square – Lower Quay of Pest – Kossuth Lajos Square, with 5 000 participants and 80 organizers. The stated purpose of the event was as follows: “To celebrate the fundamental human rights enshrined in the European Convention on Human Rights, the Charter of Fundamental Rights of the European Union and the Fundamental Law of Hungary”. The assembly authority suspended the proceedings, then resumed them and prohibited the plaintiff from holding the assembly planned for the amended date of 2 August, as it found that the content of the planned speeches related to conduct specified in the Act on the Protection of Children and the Administration of Guardianship that should not be disclosed to persons under the age of 18, and that such persons could also participate in the assembly.
The Curia found that the assembly authority had unlawfully suspended the proceedings, thereby failing to decide on the march specified in the notification within the prescribed deadline, but that the authority’s failure did not affect the merits of the decision challenged in the legal action. The decision to ban the assembly was, in its essence, well-founded and lawful, following the Curia’s previously established case-law, and therefore the Curia rejected the plaintiff’s legal action.
