on determining the fact (date) marking the conclusion of a single statutory offense in cases of budget fraud
On the basis of a motion for a preliminary ruling submitted by Panel No. B.II of the Curia, the Uniformity Panel of the Curia has issued the following uniformity decision:
- The sequence of the offense of budget fraud was closed, as a single statutory offense, by a final and conclusive decision until Section 6 (3) of Act C of 2012 on the Criminal Code, which was enacted by Section 90 of Act CXXXIV of 2021, entered into force on 1 March 2022.
- Panel No. B.II of the Curia may diverge from Decisions nos. Bhar.814/2022/26 and Bfv.134/2024/14, which have been published in the Collection of Court Decisions; any interpretation of the law differing from that set forth in point 1 may no longer be invoked as binding.
