The operative part of uniformity decision no. 9/2025 JPE

 on the effect of a final judgment on persons not parties to the lawsuit filed for the adverse possession of real estate

On the basis of a motion for a preliminary ruling submitted by Panel No. P.V of the Curia, the Curia’s Uniformity Complaint Panel has issued the following uniformity decision:

  1. In a lawsuit filed for the adverse possession of real estate, the effect of the final judgment that has upheld the claim, does not extend to persons not parties to the lawsuit.
  2. Panel No. P.V of the Curia may depart from Decision No. Pfv.22.003/2011/7, which has been published in the Collection of Court Decisions. That decision and other decisions with similar content may no longer be invoked as binding.
