The operative part of uniformity decision no. 2/2026 JPE

on a cross-petition for cassation filed solely against the reasoning part of a final and binding judgment

On the basis of a motion for a preliminary ruling submitted by Panel No. P.I of the Curia, the Uniformity Panel of the Curia has issued the following uniformity decision: 

  1. A cross-petition for cassation filed solely against the reasoning part of a final and binding judgment must be rejected in all cases.
  2. The initiating Panel of the Curia may diverge from Decision No. Gfv.30.002/2024/10, which was published in the Collection of Court Decisions, regarding the issue of legal interpretation addressed in point 1.
  3. Decision No. Gfv.30.002/2024/10 of the Curia, which was published in the Collection of Court Decisions, and other decisions of the Curia with identical content may no longer be invoked as binding in the question of legal interpretation addressed in point 1.
