on the classification of a farmer who is a local resident
On the basis of a motion for a preliminary ruling submitted by Panel No. K.IV of the Curia, the Curia’s Uniformity Complaint Panel has issued the following uniformity decision:
- If a person signs a statement of acceptance as a farmer who is a local resident in a land transaction regulated by Act CXXII of 2013 on Transactions in Agricultural and Forestry Land, and had a registered domicile and place of stay for at least 3 years prior to the exercise of his right, he must prove the habitual use of his home at his domicile. He shall be required to attach proof of this simultaneously with his statement and may not add it later in administrative court proceedings.
- When examining the applicability of the uniformity decision that is binding on courts, the temporal effect and wording of the legislation that was interpreted by the Uniformity Complaint Panel in its proceedings should be considered.
- The Curia’s Panel No. K.IV may depart from Decision No. Kfv.37.025/2024/7, which was published in the Collection of Court Decisions.
